Operation has not been tested. At the time of purchase, risk in the subject matter of the sale transfers to the successful bidder. By bidding, you agree that, regardless of the reason or cause, the court with jurisdiction over the seller's current address will have exclusive jurisdiction in the first instance, and that litigation will be brought in that court. This exclusive jurisdiction applies even to cases outside of the transaction itself. If a lawsuit is heard in a court other than the court with jurisdiction over the seller's current address, the successful bidder will be obligated to withdraw the lawsuit and waive any rights that may be the subject matter of that lawsuit. The seller reserves the right to cancel the transaction at any time for their own convenience without the buyer's consent. The seller may cancel the transaction without notice, regardless of whether the successful bidder is at fault. In any dispute arising from this transaction, the successful bidder's liability for damages will be limited to the total of the winning bid amount and shipping costs, regardless of whether the claim is for breach of contract or tort.
